Smt. P.Sudhathri v. The State Of Telangana,
HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.40858 OF 2018
ORDER
This writ petition is filed seeking the following relief: "to issue an order, direction or a writ more particularly one in the nature of Mandamus directing the respondents to approve the appointment of the 1st petitioner as SA (Maths) Grade-II from 23.03.1995 and 2nd petitioner as SBGT Assistant from 15.06.1995 with all consequential benefits to direct respondent Nos.1 to 3 to forthwith pass orders in pursuance to the report submitted by the 5th respondent in Lr.No.21/Dy.E.O/BG2/2018, dated 03.04.2018 and pass such further or other orders as this Hon'ble Court deems fit and proper in the interest of justice."
Heard Sri B.Rama Shankara Rao, learned counsel appearing for the petitioners and learned Government Pleader for School Education appearing for respondent Nos.1 to 5. It is the case of the petitioners that they were appointed as School Assistant and Secondary Grade Teacher respectively in the 6th respondent-School in the year 1995. The 6th respondent sent proposals for regularization of their services to the 3rd respondent-Regional Joint Director of School Education, Hyderabad, who, in turn, approved the appointment of the petitioners with effect from 21.5.1997. Hence, the petitioners submitted a representation to the
respondents to regularize their services from the date of their initial appointment instead of from the date of regularization of their services, on par with others, who were appointed along with them. Further, the 5th respondent recommended the case of the petitioners to the 4th respondent, who in turn, recommended the case of the petitioners to the 3rd respondent. Later, the 3rd respondent considered the recommendations made by the subordinate officers and regulations, approved the appointment of the petitioners from the date of their initial appointments i.e., 23.2.1995 in respect of the 1st petitioner and 15.6.1995 in respect of the 2nd petitioner and requested the 2nd respondent to issue necessary orders by modifying the earlier orders. But, so far, no orders have been passed by the 2nd respondent.
Learned Government Pleader appearing for the respondents submits that 2nd respondent would consider the cases of the petitioners and pass appropriate orders by duly taking into consideration the recommendations made by the 3rd and 4th respondents.
Having considered the rival submissions made by the learned counsel on either side, this Writ Petition is disposed of directing the 2nd respondent to pass appropriate orders by duly taking into consideration the recommendations made by the
subordinate officers and approve the appointment of the petitioners from the date of initial appointment i.e., 23.2.1995 in respect of the 1st petitioner and 15.6.1995 in respect of the 2nd petitioner within a period of eight weeks from the date of receipt of a copy of this order. No costs.
Miscellaneous petitions, if any, pending shall stand closed.
