THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 22571 OF 2016 O R D E R:

The order dated 29.04.2016 issued by the 3rd respondent Institute detaining the petitioner in B.E. 3/4 - II Semester, IT, during the academic year 2015-16, as he has failed to secure the requisite attendance, is challenged in this Writ Petition. The reason set-forth by the petitioner for his absence during that specific period is that he met with an accident in the college campus itself on 05.02.2015 and hence, the doctor advised him to take rest for three weeks from 05.02.2016 to 26.02.2016. But however, at page 13 of the material papers annexed to the Writ Petition, the data relating to the percentage of attendance of the petitioner, subject-wise, has been furnished, which clearly shows that for the semester-II, the petitioner has put in attendance of 57.72%.

As per the regulations governing the course, a student is required to have 75% attendance for each semester, but however, the shortage of attendance could be condoned up to 10% by the Principal concerned, on payment of certain fees. In the present case, admittedly, the petitioner has put in 57.75%. If 10% is added to it, still, it would not reach 75%. In these circumstances and in the light of catena of judgments rendered by this Court in this regard, without going into the further details of the matter, I am of the opinion that this Writ Petition deserves to be dismissed straight away and accordingly, it is dismissed. No costs. Consequently, the miscellaneous Applications, if any shall also stand dismissed.
