Bhukya Swetha, v. The State Of Telangana
THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.30365 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the inaction of the respondent Nos.1 to 3 in passing appropriate orders on the representations of the petitioner dated 27.7.2016, 30.7.2016 and 19.8.2016 as illegal and arbitrary. 2.
Heard Sri I.Koti Reddy, learned counsel for the petitioner, learned Government Pleader for Panchayat Raj & Rural Development and Sri G.Narender Reddy, learned Standing Counsel for fourth respondent-Gram Panchayat.
3.
The petitioner was elected as Sarpanch of Bhadrachalam Gram Panchayat in the year 2013. The petitioner submitted representations dated 27.7.2016 and 30.7.2016 to the respondent Nos.1 and 2 respectively. For one reason or the other, the representations are pending. While so, the petitioner submitted another representation dated 19.8.2016 to the third respondent, which is also pending.
4.
At the time of the arguments, the only relief sought by the learned counsel for the petitioner is to direct the third respondent to dispose of the representation dated 19.8.2016. The learned Government Pleader and learned Standing Counsel also consented for the same. In view of the submissions made by learned counsel for both the parties, this court is not inclined to express any opinion touching the merits of the main case.
5.
Having regard to the facts and circumstances of the case and also the submissions made by both the counsel, the third respondent is hereby directed to dispose of the representation of the petitioner dated 19.8.2016 in the light of Telangana State Panchayat Raj Act, 1994 and the relevant Rules made thereunder, as expeditiously as possible, preferably within a period of six weeks from the date of receipt of a copy of this order. 6.
With the above direction, the writ petition is disposed of. Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
