This writ petition is filed to declare the action of the respondents 3 to 5 in interfering with petitioner's possession and enjoyment of the property to an extent of Ac.015 cents situated appurtenant to her land to an extent of Ac.1.76 cents in RS.No.118/8 of I-Polavaram Village and Mandal and making efforts to dispossess her from the said land without due process of law as illegal and arbitrary.
In the counter affidavit filed on behalf of respondent No.3, it is stated that in Sy.No.118/11 and adjacent to the mentioned property of the petitioner, there is government land to an extent of Ac.0-56 cents and since time immemorial, the villagers are using some part of said Ac.0-56 cents as burial ground. Learned counsel for the respondents states that burial ground is existing in Sy.No.118/11, whereas the petitioner claims land in Sy.No.118/8.
In view of the same, recording the same, the writ petition is disposed of with a direction to the respondent-authorities not to dispossess the petitioner from her land admeasuring Ac.01-76 cents in R.S.No.118/8 and Ac.0-16 cents in RS.No.146/2 of I-Polavaram Village and Mandal without following due process of law.
