HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.40743 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the respondents 1 and 2, in not considering the representation dated 14.8.2018, submitted by the petitioner to initiate action against the illegal and unauthorized constructions being raised by the 3rd respondent, in the premises bearing H.No.131-1188/1/A, Mustaidpura, Tappachabutra, Hyderabad, as illegal and arbitrary.

Though various grounds are urged, learned counsel for the petitioner submits that the writ petition may be disposed of directing the 2nd respondent to pass appropriate orders on the representation dated 14.08.2018, submitted by the petitioner seeking to initiate action against the illegal constructions made by the 3rd respondent in the above said premises.

Learned Standing Counsel for the respondents 1 and 2, would submit that since the interim prayer and the main prayer are one and the same, the respondent-authorities, may be directed to dispose of the representation of the petitioner, in accordance with law. Having regard to the above, the writ petition is disposed of directing the respondents 1 and 2, to deal with the representation dated 14.08.2018, made by the petitioner seeking to initiate action against the illegal constructions made by the 3rd respondent in the subject premises and pass appropriate orders, as early as possible, in accordance with law, after giving reasonable opportunity of hearing to the petitioner and all concerned. No order as to costs.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
