THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.22409 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the inaction of the respondents in renewing the leasehold fishing rights of the petitioner for the tanks of Panchalamarri Village, Yerasanipilli Grama Panchayat and Kotakonda Village of Thambalapalli Mandal, Chittoor District in terms of the G.O.RT. No.48, dated 20.02.2016 Fisharies Department for the Fasili 1425 to 1427 from 01.07.2015 to 30.06.2018 as illegal, arbitrary, vilolation of law and consequently direct the respondents to consider the same.

Heard the learned counsel for the petitioner, the learned Government Pleaders for Fisheries (AP), Panchayat Raj and Rural Development (AP) and Revenue (AP) and Sri G.Seshadri, the learned Standing Counsel for Z.P.P.-M.P.P.-G.P.P.

It is not in dispute that the petitioner had participated in the auction conducted on 24.12.2015 and became highest bidder. The petitioner is entitled for fishing rights for a period of one year only. It is also not in dispute that the Government of Andhra Pradesh issued G.O.RT.No.48, Fisheries Department, dated 20.02.2016 to extend the lease period for a period of three years by enhancing the rent by 10% over the previous year, every year, except in the drought declared Mandals.

The contention of the petitioner is that he submitted a representation dated 18.06.2016 to the District Collector, Chittoor to extend the benefit of G.O.Ms.No.48 to him.

The contention of the respondents is that the petitioner is not entitled for extension of lease period.

The only relief sought by the petitioner is to direct respondent Nos.2 to 7 to dispose of his representation.

In view of the submission made by the learned counsel for the petitioner, this Court is not inclined to go into the merits of the main case.

Having regard to the facts and circumstances of the case, respondent Nos.2 to 7 are hereby directed to dispose of the representation of the petitioner dated 18.06.2016, in accordance with law, as expeditiously as possible, preferably within a period of one (1) month from the date of receipt of a copy of this order. Accordingly, the Writ Petition is disposed of. No costs. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
