HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.44512 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to call for the records in FIR No.327 of 2016, as illegal and arbitrary and consequently to quash the same.

Heard and perused the material available on record. The case of the petitioner is that the 5th respondent lodged the present complaint against the petitioner and others, which was registered by the 4th respondent as FIR No.327 of 2016 for the offence under Section 306 read with 511 IPC, wherein it is alleged that on 24.11.2016 at 4.00 hours at Weavers Colony, Jangaon, the 5th respondent's niece Oddula Varalaxmi tried to commit suicide by pouring kerosene on herself and lit fire and immediately she was shifted to Hospital for treatment and that on enquiry, the niece of the 5th respondent came to know that she joined as a member in "Mahila Group" and took Rs.

20,000/- as loan from their group and repaying the installments every month to the group and also took hand loans from group members and paying interest and even after that the accused along with petitioner, who is A-3, abused her in filthy language and took away her household articles like colour TV, Gas cylinder etc., and that due to their acts, she felt insult and tried to commit suicide. The main grievance of the petitioner is that the 4th respondent is calling the petitioner to the police station even though there is no necessity.

she has not given any amount. Learned counsel for the petitioner further submitted that the petitioner is ready to co-operate with the investigation.

Considering the grievance of the petitioner and that the petitioner being a lady, the 4th respondent is directed to complete the investigation in FIR No.327 of 2016, as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner. The petitioner is directed to execute a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for the like sum to the satisfaction of the 4th respondent as surety for her future appearance for the purpose of investigation.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ____________________ RAJA ELANGO, J Date: 21st December, 2016 KL
