This Writ Petition, under Article 226 of the Constitution of India, is filed for the following relief :
"To declare the Proceeding dt. 10.10.2018 vide ROC No.684/ 2018 (B) and consequent proceedings dt.
5.11.2018 under ROC No.684/ 2018(B) issued by respondent No.4 are illegal and arbitrary and unconstitutional and violative of principles of natural justice and the provisions of Land Encroachment Act, 1905."
Learned Assistant Government submits that alternative remedy of appeal is available to the petitioner. Learned counsel for the petitioner says that in the Order dt.05.11.2018 itself, the Executing Officer was asked to be ready along with machinery for demolition of the building. Since the petitioner is having the alternative remedy of appeal, this Court is not inclined to entertain the present Writ Petition.
However, there shall be suspension of the Order dt.05.11.2018 for a period of two weeks to enable the petitioner to file appeal before competent authority.
With the above direction, this Writ Petition is disposed of. The miscellaneous Petitions, if any, pending in this case shall stand closed.
