HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38381 of 2016 ORDER:

The present writ petition is filed by the petitioner seeking to declare the action of the 3rd respondent in seizing the petitioner's Goods Carriage Vehicle bearing No.TS 08UA 3129 on the ground that it was allegedly transporting PDS rice and detaining in his custody without releasing it to the petitioner, as illegal and arbitrary, and consequently, direct the respondents to release the petitioner's vehicle. Heard and perused the material available on record. The learned counsel for the petitioner submitted that there is no proof to show that the vehicle of the petitioner was involved in transporting the PDS rice, and that the same was seized on 03.09.2016 and since then it is lying in 3rd respondent police station and it was not produced before the Court concerned, and if the vehicle is kept lying idle, it will get damaged and therefore, he requested to direct the 3rd respondent to produce the vehicle before the Court concerned, to enable to petitioner to file an application before the Court concerned, for return of the said vehicle.

Considering the facts and circumstances of the case and in view of the submissions of the learned counsel for the petitioner, the 3rd respondent is directed to deposit the vehicle of petitioner bearing No.TS 08UA 3129 before the Court concerned, as expeditiously as possible.

Accordingly, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
