HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No. 4 0 7 3 9 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Inspector of Police, Raidurgam Police Station, dated 13.11.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "The petitioner herein has approached the police of Raidurgam Police Station and lodged a complaint on 30.10.2018 stating that one Mrs.Nasreen Osmani, W/ o.Mohd.Abdul Majeed and Mohd.Abdul Majeed both resident of Tolichowki, Hyderabad, offered to sell the plot bearing No.234 (eastern portion) in Sy.No.51, admeasuring 177.5 Sq.Yds., situated at Gachibowli village, Serilingampali Mandal, for an amount of Rs.

23,00,000/ - and both the above named persons with their sweet talk, induced him to part with his hard-earned money and entered into an agreement of sale in respect of aforementioned property on 06.04.2014 at their residence and on the date of agreement of sale, he paid a sum of Rs.5,05,000/ - towards advance consideration and she has taken further amount from time to time under the name of her husband's health and her daughters marriage and thus she collected an amount of Rs.14,00,000/ - till date and after entering into agreement of sale, he came to know that Mrs.Nasreen Osmani and her husband deliberately suppressed the fact of Court litigation in respect of the subject property pending against her own brother and on coming to know the same, on 26.10.

Upon receipt of the said complaint, an entry was made into the Station General Diary, after enquiry action will be taken.

In the preliminary enquiry, it is clearly revealed that the dispute of the petitioner herein is clearly money transaction as well as purely civil in nature and advised him to seek his redressal in a competent Court of law.

I humbly submit that since the dispute of the petitioner as well as the unofficial respondents herein is purely civil in nature and hence no action was taken on the said complaint.

I humbly submit that the petitioner unnecessarily involving the respondent police into his personal civil and money transaction dispute which cannot be entertained by the police.

A notice, dated 12.11.2018, was also sent to the petitioner through post informing the result of the enquiry of the petition."

Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Sub-Inspector of Police, Raidurgam Police Station, dated 13.11.2018. However, it is open for the petitioner herein to avail the remedies available to him in accordance with law.
