HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.40767 of 2018 ORDER :

Case of the petitioner is that the petitioner has made an application for conducting survey of the subject lands in Sy.Nos.442 and 446 of Dundigal village of Dundigal Gandimaisamma Mandal, Medchal Malkajgiri District, Telangana State. When the same is not done, petitioner filed an appeal before the 2nd respondent on 26.02.2018. In pursuance of the same, notices were issued, but no survey is conducted. Aggrieved by the same, the present writ petition is filed. Learned Assistant Government Pleader submits that though the Deputy Inspector of Survey was appointed for conducting survey of the subject lands, as there are lot of objections from the villagers, survey could not be taken up. It is stated that as the appeal is pending before the 2nd respondent, the 2nd respondent may be directed to dispose of the same.

Taking into account the facts and circumstances of the case, there shall be a direction to the 2nd respondent to dispose of the appeal expeditiously after issuing notices to the aggrieved persons and by considering their objections, and take action in accordance with law. With the above directions, the writ petition is disposed of. No order as to costs.
