THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 34595 OF 2017 O R D E R:

The inaction of respondent No.1 in disposing of the revision petition, dated 18.09.2017, including stay petition, filed by the petitioners against the order dated 01.08.2017 passed in CMA.No.106 of 2008 on the file of Additional Agent to Government, East Godavari at Rampachodavaram, is questioned in the Writ Petition as illegal and arbitrary. Though various grounds are raised, learned counsel for the petitioners restricts his prayer for issuing a direction to the revisional authority to dispose of the main revision or the stay application filed by the petitioners at the earliest. Having regard to the fact that the petitioners are in possession of the land in dispute and are apprehending eviction, they plead stay of the impugned order. The same is opposed by the learned Government Pleader for Social Welfare, who, however, states that respondent authorities may be directed to dispose of the stay application or the main revision, in accordance with law at the earliest.

Having regard to the statements made across the Bar, the Writ Petition is disposed of directing the revisional authority to dispose of the revision petition filed against the order dated 01.08.2017 passed in CMA.No.106 of 2008 by the Additional Agent to Government, East Godavari at Rampachodavaram, as

early as possible, preferably, within a period of eight weeks from the date of receipt of a copy of the order. It is made clear that the revisional authority shall make a speaking and reasoned order after giving due opportunity to the parties involved, as otherwise, the same would be liable to be set aside for failure to do so which would defeat the very exercise done.

Consequently, the miscellaneous petitions, if any shall stand disposed of.
