Heard learned counsel for the petitioner and the learned Government Pleader for Social Welfare (A.P.) appearing for respondent Nos.1 and 2.

The grievance of the petitioner in the present writ petition is the alleged inaction on the part of the Special Deputy Collector (Tribal Welfare), Rampachodavaram, East Godavari District/respondent No.2 herein in disposing of L.T.R.P.No.8 of 2016.

According to the petitioner, he belongs to Schedule Tribe (Koya) community and he is a permanent resident of Yandapalli Village, Gangavaram Mandal, which falls under scheduled area of East Godavari District. The petitioner herein claims to be the owner of land to an extent of Ac.0.15 cents in Sy.No.23/3a situated in Addateegala Village and Mandal, East Godavari District having purchased the same from one Smt Lingampalli Venkataramanamma, W/o.late Surya Rao on 16.06.2015. It is further stated that the petitioner herein filed a petition before respondent No.2 under Section 3 of the Andhra Pradesh Schedule Areas Land Transfer Regulation 1/59 as amended by 1/70 for restoration of the said land by ejecting respondent No.3, who is a non-tribe.

It is submitted by the learned counsel for the petitioner that despite lapse of considerable length of time, respondent No.2 is not

disposing of the said L.T.R.P.No.8 of 2016 and in view of the said inaction, the petitioner herein is sustaining irreparable loss and hardship.

The information available before this Court discloses that on the complaint of the petitioner herein, respondent No.2 issued Form - E notice of enquiry to respondent No.3 herein, fixing the date of enquiry as 08.12.2016 at 3:00 P.M. Having heard the learned counsel for the petitioner and the learned Government Pleader and taking into consideration the nature of controversy, this Court deems it appropriate to dispose of the present writ petition with a direction to the Special Deputy Collector (Tribal Welfare), Rampachodavaram, East Godavari District/respondent No.2 herein to complete the enquiry initiated pursuant to Form - E notice in L.T.R.P.No.8 of 2016 and pass appropriate orders within a period of two (2) months from the date of receipt of a copy of this order after hearing the petitioner as well as the unofficial respondent herein.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
