THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.39079 of 2017 ORDER:

The petitioner was appointed as a Typist on 22.06.1993 in the second respondent Society and was posted at Yerragandlapalem, Prakasam District. Subsequently he was promoted as Senior Assistant in June, 2005, and further promoted as Superintendent in the year 2012. He was working in Nagarjuna Sagar, Guntur District. While so, in respect of certain irregularities that took place during the years 2012 to 2016 an enquiry was conducted against the petitioner, which ultimately ended in imposing a major punishment of withholding four increments with cumulative effect. However, after imposing the said major penalty, when an order of transfer was passed on 15.11.2017 transferring the petitioner from Nagarjuna Sagar, Guntur District, to Somasila, Nellore District, on administrative grounds, the present Writ Petition is filed. Learned Counsel for the petitioner submits that the transfer order is punitive and also effected in the middle of the academic year.

A reading of the impugned order shows that the authority thought it fit to shift the petitioner to far away and non focal area immediately and, accordingly, effected the transfer. What weighed with the administrative authority cannot be appreciated by this Court in exercise of its extraordinary

jurisdiction when the transfer was effected on administrative grounds. This Court is not inclined to interfere with the discretion exercised by the administrative authority. In the circumstances, this Court sees no ground to entertain the present Writ Petition, and the same is, accordingly, dismissed. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
