ORDER:
This writ petition is filed for a mandamus to declare the action of respondent Nos.1 and 2 in trying to dispossess the petitioners from the shops in their possession in survey No.167/2 (part) bounded by North - road leading to Jaipur and South - by the compound wall of the Tahsildar's office, Salur, Vizianagaram District, as illegal and arbitrary. At the hearing, Mr.Nimmagadda Venkateswarlu, learned standing counsel for Municipalities (AP) appearing for respondent Nos.1 and 2, on instructions, has submitted that the shops adjacent to the office of respondent No.3 are situated in survey No.162/2 and the petitioners are claiming ownership over the land in survey No.167/2 (part). He has, however, hastened to submit that respondent Nos.1 and 2 have not been taking any action against the petitioners for eviction as it is for respondent No.3, who is interested in the property in question on behalf of the State as the property belongs to the Government, to take such action.
The above submissions of the learned standing counsel for Municipalities (AP) appearing for respondent Nos.1 and 2 are placed on record and the Writ Petition is disposed of accordingly. As a sequel to disposal of the writ petition, W.P.M.P.No.2754 of 2016 filed by the petitioners for interim relief shall stand disposed of as infructuous.
