Petitioner is one of the candidates responded to the Teachers Recruitment notification issued in the year 2012. Petitioner's candidature was not favourably considered on the ground that he was not eligible for consideration for appointment to the post of Post Graduate Teacher in Model Schools. On a representation made by the petitioner an endorsement was given to him vide proceedings dated 22.12.2014 informing him that he passed Bachelor of Education after the notification dated 15.12.2012 and that he attended to the B.Ed., Theory and practical during August, 2012 and therefore, not eligible.

It is clear from this endorsement that petitioner was not considered for recruitment of PGT in Economics, in pursuant to 2012 notification on the ground of his ineligibility and to that extent a reply was given to him in December, 2014. This writ petition is filed almost after three years. In matters of recruitment, time is essence. Prima-facie, it cannot be said that the reply given to the petitioner is erroneous and would amount to illegal denial of employment. The qualifications are required to be possessed by the candidate as per the conditions prescribed in the recruitment notification and if petitioner does not fulfil those qualifications, he cannot complain of non-selection. Further once the selections are finalized, it involves third party interests.

Therefore, I do not see any merit in the writ petition and the same is liable to be dismissed.

Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
