Heard learned counsel for the petitioners, learned Government Pleader for Panchayat Raj for respondent No.1, learned Government Pleader for Revenue for respondents 2 to 4 and Sri G. Narender Reddy, learned Standing counsel for respondent No.5.

According to petitioners, they are the owners of land in Sy.Nos.45 and 46 admeasuring Ac.4.00 guntas each situated at Vardavelli Village, Boinipelli Mandal, Rajanna Sircilla District. According to them though they are no way concerned with the land in Sy.Nos.43 and 44 of Vardavelli Village, Boinipelli Mandal, Rajanna Sircilla District, notice dated 25.10.2018 was issued to them stating that no cultivation or any structures are allowed and the same cannot be used for private purpose as the said land is handed over to the Gram Panchayat for the purpose of Grave yard.

Learned Standing counsel submits that there was an error in mentioning the survey number. The proposed construction of burial ground is in Sy.Nos.43 and 45 but by mistake Sy.No.44 is mentioned.

Be that as it may, when petitioners clearly state that they are no way concerned with the lands in Sy.Nos.43 and 44 notice could not have been issued to them. It appears there was no verification of records and mechanically notice was issued.

If what is stated by learned Standing counsel is true, it is open to the Gram Panchayat to take appropriate steps as required by law.
