THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1863 OF 2016 ORDER:

This Criminal Revision Case is filed by the petitioners/A-1 and A-2 challenging the order, dated 2.6.2016, in Crl.M.P.No.755 of 2016 in C.C.No.368 of 2015 on the file of the XIV Special Magistrate, Hyderabad.

2. The offences alleged against the petitioners are punishable under Sections 138 and 142 of the Negotiable Instruments Act, 1881. Pending C.C.No.368 of 2015, respondent No.1/complainant filed Crl.M.P.No.755 of 2016 to substitute Sri Koppaku Srinivas Rao, Chief Accounts Officer in the place of Sri V.S.N.S.Gupta, Accounts Officer to represent and conduct the case on behalf of the complainant company, and the same was allowed. Challenging the same, the petitioners filed the present Criminal Revision Case.

3. Heard and perused the material available on record.

4. After arguing for sometime, learned counsel for the petitioners, while not pressing for the main prayer, confined his arguments only to the extent of dispensing with the presence of the petitioners before the trial Court.

5. As the offences alleged are under Sections 138 and 142 of the Negotiable Instruments Act, the question of identification of the petitioners does not arise. Considering the facts and circumstances of the case, the presence of the petitioners before the trial Court is dispensed with except on the dates on which the learned Magistrate insists for their appearance.

The petitioners shall be properly represented through their counsel before the trial Court.

6. Accordingly, this Criminal Revision Case is disposed of.

7. Miscellaneous petitions pending, if any, in this Criminal Revision Case shall stand closed.
