HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.4030 OF 2016 ORDER:

This Writ Petition is filed by the petitioner invoking Article 226 of the Constitution of India seeking to declare the inaction of respondents in considering and disposing of the representation of the petitioner made on 07.01.2016 as illegal and arbitrary.

Heard the learned counsel for the petitioner as well as the learned Assistant Government Pleader for Revenue for respondents. With their consent, the writ petition is disposed of at the stage of admission itself.

As seen from the material on record, the petitioner made a representation on 07.01.2016, on behalf of 76 persons, to the Chief Minister, Telangana State, seeking grant of patta. The appropriate authority for grant of patta is the District Collector. Though a copy of said representation was marked to the 3rd respondent-District Collector, there is no proof to show that the same has reached the office of the 3rd respondent.

At this stage, the learned counsel for the petitioner submits that the petitioner may be permitted to make a fresh application before respondents 2 and 3.

Learned AGP would submit that the petitioner has no locus to make application on behalf of 76 members.

Considering the rival submissions made, the Writ Petition is disposed of leaving it open to the petitioner to make a fresh application before appropriate authority, in accordance with law, in

which event the same shall be dealt with in accordance with law, at the earliest.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No order as to costs.
