HON'BLE SRI JUSTICE S.V. BHATT W.P. No.36172 OF 2017 ORDER:

Heard Smt.J.Sumathi for petitioner and the Assistant Government Pleader for School Education.

The petitioner challenges proceedings Rc.No.10140/ B8/ 2017 dated 18.09.2017 of 2nd respondent as illegal and contrary to G.O.Ms.No.1 dated 01.01.1994.

The case of petitioner is that the petitioner now complies with Rules 5 and 9 of the Rules and the application for renewal ought not to have been rejected. The Assistant Government Pleader submits that the details, if are really submitted by petitioner, it is matter of record and the petitioner ought not to be making bald allegations. To the pointed query of the Court, what are the documents filed and what is the deficiency in the application filed by the petitioner, by reading the impugned proceedings, he submits that the expression used by 2nd respondent is 'some deficiency' and there is no certainty on what is required to be complied with.

Under these circumstances, instead of keeping the writ petition pending or this Court getting into the merits which otherwise would have been considered by the 2nd respondent, that the petitioner can be given one more chance to re-submit the application in accordance with Rules 5 and 9 of G.O.Ms.1 dated 01.01.1994.

and the 2nd respondent is directed to re-examine the issue and pass orders within four weeks thereafter.

No order as to costs.
