Heard learned counsel for the petitioner and the learned Government Pleader for Roads & Buildings (A.P.) appearing for respondent Nos.1 to 5.

When the matter is called, it is submitted by learned counsel for the petitioner that the issue in the present writ petition is squarely covered by the order, dated 04.09.2017, in W.P.No.29778 of 2017 of this Court. A copy of the same is filed along with writ material papers. It is also submitted by the learned counsel that without properly considering the ground realities, technical bid of the petitioner herein has been rejected. However, it is submitted by the learned Government Pleader that all the aspects were gone into and the above referred order was passed. 3.

As it is the complaint of the petitioner that his tender has been disqualified on unsustainable grounds, he can raise his objections before respondent No.4 herein within a period of one week from the date of receipt of a copy of this order. If any such objections are raised before respondent No.4, the same may be considered and appropriate further action may be taken in accordance with law after giving opportunity to all the stakeholders. Till the objections of the petitioner are considered and appropriate orders are passed, there shall be no finalization of the subject tender.

Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.

Office to enclose a copy of the order, dated 04.09.2017, in W.P.No.29778 of 2017 to this order.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
