THE HONOURABLE SRI JUSTI CE SANJAY KUMAR CONTEMPT CASE NO.791 OF 2016

O R D E R

This contempt case was instituted alleging willful disobedience to the order dated 12.02.2016 passed in W.P.No.4629 of 2016. By the said order, the police authorities were directed to take appropriate action upon the petitioner's complaint dated 24.01.2016 in the light of the law laid down by the Supreme Court in LALI TA KUMARI V/ s. GOVERNMENT OF UTTAR PRADESH1.

The Circle Inspector of Police, Miryalaguda Rural Police Station, filed a counter-affidavit stating that basing on the complaint made by the petitioner, Crime No.13 of 2016 was registered on the file of his Police Station under Sections 448 and 427 read with 34 IPC and a charge-sheet was laid in C.C.No.470 of 2016 on the file of the learned Judicial First Class Magistrate, Miryalaguda.

In the light of the aforestated averments, which remain unrebutted, it is clear that there is no disobedience, much less willful disobedience, to the subject order.
