THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8561 OF 2016 ORDER:

This petition is filed by the petitioner-accused No.3 under Sections 437 and 439 Cr.P.C. seeking to grant bail to him in Crime No.3 of 2016-17 on the file of Prohibition & Excise Police Station, Rajahmundry (North).

It is alleged that the petitioner was found in possession of 112 kgs of ganja.

Learned Counsel for the petitioner submitted that the petitioner has been in prison since 4.4.2016 and therefore, a lenient view may be taken.

Learned Additional Public Prosecutor opposed this petition. Since the quantity of ganja seized from the possession of the petitioner is commercial, this Court is not inclined to grant bail to him.
