THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI Writ Petition No.37865 of 2017 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking verbatim the following relief: " ..to issue a writ or order or direction more particularly in the nature of Writ of Mandamus declaring the action of the respondents in collecting the Tax for the entire quarter in respect of vehicles of the Petitioner bearing Nos.AR 02-6733, AR 02-6734 and AR 02-6526 vide receipts dated 17.05.2017 and 03.06.2017 as illegal, arbitrary, and contrary to G.O.Ms.No.83 Tr. R & B (Tr-II), dated 26.03.1980 and consequently direct the 3rd respondent to refund the excess Tax collected by the 4th respondent on 17.05.2017 and 03.06.2017 as per application dated 24.08.2017 in respect of above vehicles and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

I have heard the submissions of Sri B.Siva Rama Krishnaiah, learned counsel appearing for the petitioner, and of the learned Government Pleader for Transport (AP) appearing for the respondents 1 to 4.

At the hearing, learned counsel for the petitioner and the learned Government Pleader would submit that the issue involved in this writ petition is squarely covered by the orders, dated 11.09.2017, of this Court passed in W.P.No.29443 of 2017, and that therefore, this writ petition may also be disposed of in terms of the order in the said writ petition.

Recoding the aforesaid submissions and for the reasons alike as were mentioned in the aforesaid orders of this Court passed in
MSRM, J W.P.No.37865 of 2017 W.P.No.29443 of 2017, this Writ Petition is disposed of directing the 3rd respondent to pass orders on the representation, dated 24.08.2017, of the petitioner, within a period of three weeks from the date of receipt of a copy of this order.
Office is directed to enclose to this order, a copy of the order, dated 11.09.2017, passed in W.P.No.29443 of 2017. There shall be no order as to costs.
