Heard learned counsel for the petitioner and learned Standing Counsel for the respondents 2 and 3.

The petitioner is a disposable plastic manufacturing unit run by a partnership firm. It is situated in Plot No.21, Industrial Park, Venkatachalam, Kakutur village, Venkatachalam Mandal, SPSR Nellore District. It was registered with the Commercial Tax Department. An application was filed for power connection to the said unit in September 2014, a service connection was sanctioned and the power supply was commenced from August 2015. They commenced production in August 2015 itself. Nearly 20 employees are employed by the petitioner unit. However, the petitioner could not run the unit on regular basis due to bad market conditions and the arrears of power consumption charges came to Rs.8,49,821/-. In view of the arrears of power consumption charges, the power connection was disconnected on 13.08.2017.

The petitioner sought for time to pay the arrears amount in instalments and the case of the petitioner was recommended to the Chief General Manager way back on 12.09.2017, but the Chief General Manager, Tirupati has not passed any orders. In those circumstances, they filed the present Writ Petition. A perusal of the letter of the Superintending Engineer, Operation, Nellore addressed to the Chief General Manager, APSPDCL, Tirupati indicates that an amount of Rs.9,96,703/- is outstanding as on the date of disconnection and the instalments recommended are six (6).

In the circumstances, this Court feels that if the petitioner pays an amount of Rs.2,50,000/- (Rupees Two Lakhs Fifty Thousand only) within a period of ten (10) days from the date of receipt of a copy of this order, the service connection of the petitioner shall be restored and the petitioner shall pay the balance of arrears amount on or before 10th of every succeeding month in equal monthly instalments commencing from December 2017 and shall continue to pay the current consumption charges without fail. If the petitioner fails to pay any two consecutive instalments, it is open to the respondents to disconnect the power supply without any further notice.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
