HON'BLE SRI JUSTICE SURESH KUMAR KAIT CRIMINAL PETITION No. 17075 of 2016 ORDER:

Vide the present petition, the petitioner/accused seeks direction thereby to relax the conditions imposed on him, vide order dated 12.09.2016 in Crl.M.P. No.2527 of 2016 on the file of the Metropolitan Sessions Judge-cum-Special Judge to try the offences under the NDPS Act, Visakhapatnam.

Heard both the learned counsel appearing on behalf of the petitioner and the learned Additional Public Prosecutor appearing on behalf of the respondent-State.

Having regard to the facts and circumstances of the case, the condition of furnishing fixed deposit for a sum of Rs.50,000/- imposed against the petitioner, vide order dated 12.09.2016 in Crl.M.P. No.2527 of 2016 on the file of the Metropolitan Sessions Judge-cum-Special Judge to try the offences under the NDPS Act, Visakhapatnam, is hereby relaxed and the rest of the conditions shall remain in tact.

Accordingly, the Criminal Petition is allowed. 5.

As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
