Heard learned counsel for the petitioner, who is 1st respondent in DVC.No.6 of 2016, including the interim protection order dated 03.03.2016 covered by Crl.M.P.No.154 of 2016 passed by the learned Judicial Magistrate of First Class, Godavarikhani, Karimnagar District.

Undisputedly from the wording of Section 29 of Domestic Violence Act, appeal lies to the Court of Session including against the impugned order dated 03.03.2016 in Crl.M.P.No.154 of 2016 of the learned Magistrate.

Having regard to the above, the Criminal petition is disposed of by giving liberty to the petitioner by virtue of this order to file appeal under Section 29 before the Court of Session within one week from the date of receipt of a copy of this order and in such event, the learned Sessions Judge shall entertain the appeal without considering the period of limitation. Consequently, miscellaneous petitions, if any shall stand closed.
