This writ petition is filed challenging the action of the respondents 2 to 4 in not acting upon the illegal closure and encroachment of agriculture water channel and access by the 5th and 6th respondent in land in S.No.35/3A and 31/4B/2, admeasuring Ac.0.71 Cents to the petitioner agriculture lands admeasuring Ac.1.51 cents in Sy.No.34/4A, situated at Anaparthi Village and Mandal, East Godavari District, even after receiving notice dated 31.10.2017, representation dated 01.02.2018 by 2nd respondent and filing of PLC No.276 of 2018 before Mandal Legal Services Authority, Ramchandrapuram. Learned Assistant Government Pleader for Revenue produced written instructions stating that the Revenue Divisional Officer, Ramachandrapuram, vide his letter dated 29.06.
18.07.2018 to the petitioners as well as to the respondents 5 and 6 to attend with record of their defense; and accordingly the writ petitioner attended on 19.07.2018; and that the respondent through his men, finally agreed to remove the encroachment made by him on the field channel, abutting the R&B road and accordingly he has removed the encroachment and cleared the water way with JCB and the same was also verified by the Tahasildar, Anaparthi. It is also stated that the writ petitioner and his son have further filed a PLC No.276/2018 in the Court of the Hon'ble Lok Adalat-Senior Civil Judge, Ramachandrapuram; and that the same is still pending and no final orders are passed by the said Court.
The aforesaid written instructions submitted by the learned Assistant Government Pleader go to show that the grievance of the petitioner stood redressed. In view of the same, recording the aforesaid instructions, the writ petition is disposed of. If petitioner's application for conversion is pending, it is for the respondents to consider the same, in accordance with law and take action. No order as to costs.
