Kirthi D Shah, Hyderabad. v. Authority Under Minimum Wages Act And Assistant Commissioner
HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.9931 OF 2002
ORDER
When the matter is taken up for hearing, it is noticed that the writ petition against contesting respondents 3 and 4 was dismissed for default vide order dated 18.08.2010. Since the petitioner is challenging the order of the Authority under the Minimum Wages Act, passed in favour of respondents 3 and 4, the issue raised in the writ petition cannot be adjudicated, in the absence of respondents 3 and 4.
Though the writ petition was dismissed for default against contesting respondents 3 and 4, no steps have been taken by the petitioner to restore the writ petition against them and therefore, the writ petition is liable to be dismissed.
Accordingly, the Writ Petition is dismissed as infructuous. No costs.
Miscellaneous petitions, if any, pending shall stand closed. ________________________________ JUSTICE ABHINAND KUMAR SHAVILI 29th August, 2018 rkk
