HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.5496 OF 2002 ORDER:
When the matter is taken up for hearing, the counsel appearing for the petitioner had contended that in this writ petition, the petitioner is challenging the interlocutory order passed in I.A.No.138 of 2002 in E.I.C.S.R.No.1709 of 2002, dated 21.03.2002, wherein the Employees Insurance Court-cum-Industrial Tribunal had waived the condition of the 2nd respondent herein depositing 50% of the demanded amount. It is also submitted that since no interim orders were granted by this Court, the cause in the writ petition does not survive. This Court, having considered the above contentions, is of the considered view that since no interim orders were granted by this Court, it is always open for the Employees Insurance Court-cumIndustrial Tribunal to adjudicate the case being E.I.C.S.R.No.1709 of 2002 in accordance with law, if not already adjudicated, after giving opportunity to all the effected parties.
With the above observations, the writ petition is disposed of. No costs.
