THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5282 OF 2016 ORDER:

This Criminal Petition is filed by the accused under Section 482 Cr.P.C. seeking to quash the proceedings in C.C. No.800 of 2015 pending on the file of XVII Additional Chief Metropolitan Magistrate, Hyderabad for the offence under Section 461 IPC.

The grounds now raised by the learned counsel for the petitioner for quashing the impugned proceedings are all disputed questions of facts which can be adjudicated by the trial Court only after full-fledged trial. Hence, this Court is not inclined to interfere with the impugned proceedings. The petitioner is at liberty to file a discharge application raising all the points now raised in this petition and the trial Court shall consider and dispose of the same on merits. Till disposal of the discharge application, the presence of the petitioner before the trial Court is dispensed with.

The Criminal Petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
