THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.23297 of 2016 ORDER :

This writ petition is filed to declare the action of the respondents in rejecting the representation of the petitioner to work at Hyderabad unit on medical grounds and transferring him to ONGC Unit Mumbai vide transfer orders No.

E-38014/06/PK/Karmik/2016/03973 dt.09.06.2016 as illegal, unjust and to set aside the same and to direct the respondents to continue the petitioner in the present unit i.e., Respondent No.4 CISF Unit, BHEL, Hyderabad for one tenure.

No representation for the petitioner on 07.03.2017. To give one opportunity, the matter is listed today under the caption "for dismissal". Today also there is no representation even though matter is listed under the caption "for dismissal". 3.

Learned Standing counsel representing learned Assistant Solicitor General, submits that petitioner sought for retention and opposed transfer on the ground that his application for voluntary retirement was pending consideration. However, by order dated 09.12.2016 his application for voluntary retirement was accepted and accordingly, petitioner was retired from service. Learned Standing counsel produced the order dated 09.12.2016 accepting the claim of the petitioner for voluntary retirement dated 25.10.2016 and proceedings dated 09.12.2016 whereunder petitioner was relieved from service. This may be the reason the petitioner is not interested in prosecuting the writ petition.

Having regard to the above the writ petition is dismissed for non-prosecution. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
