HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 37045 OF 2017 ORDER:

This writ petition is filed seeking writ of mandamus declaring the notice No.60T, dated 03.10.2017 on the file of 2nd respondent, as illegal and arbitrary and consequently to direct the respondents not to interfere in the peaceful possession and enjoyment of the subject property. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Irrigation.

Learned counsel for the petitioner submits that the 2nd respondent has straight away issued the impugned notice dated 03.10.2017, without preceding any notice to vacate the premises.

Learned Assistant Government Pleader for Irrigation submits that the respondents will follow due process of law in vacating the petitioners.

Recording the submission of the learned Assistant Government Pleader for Irrigation, the respondents are directed not to evict the petitioners, without following due process of law.

With the above direction, this writ petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of.
