HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.37306 OF 2017 O R D E R :

This writ petition is filed challenging the action of the 4th respondent in not issuing the permission for loading and unloading of sand from the land of the petitioner, situated on the Krishna river bank, near Bhavani Ghat, Vijayawada. The case of the petitioner is that he is into earth movers business, and during the course of his business, he made representation to the concerned authorities for lifting of sand from his own land. But, due to closer of Bhavanipuram sand reach during Krishna Pushkaralu period, nearly gangaputhra workers have became jobless and going for daily labour works.

The petitioner gave representation on 17.07.2017 to the respondents for permission for lifting the same, the 5th respondent issued a letter on 21.07.2017, stating that the 3rd and 4th respondents visited the ramp places at Bhavanipuram and they made full-fledged enquiry on 14.07.2017, but not passed any orders (permission) for lifting the same from the petitioner's place. Aggrieved by the same, present writ petition is filed.

Heard learned counsel for the petitioner.

Learned Government Pleader for Industries and Commerce produced written instructions and states that the

approachability to the applied areas seeking ramp permission is very narrow and it is not feasible.

Now it is to be seen that when application is filed by the petitioner seeking permission for loading and unloading of sand from his land and proceedings were issued basing on the same, it is for the competent authority to consider the application of the petitioner in accordance with Rules and take action.

In view of the same, without expressing any opinion on merits, the writ petition is disposed of directing the competent authority to dispose of the application of the petitioner, in accordance with law and take action within a period of two weeks from the date of receipt of a copy of this order. No order as to costs.
