THE HON'BLE SRI JUSTICE RAJA ELANGO Crl.P.No.6102 of 2016

ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioners/A1 to A3 seeking to quash the proceedings in C.C.No.220 of 2016 on the file of XXIV Metropolitan Magistrate, Kukatpally at Miyapur, Cyberabad, registered for the offences punishable under Sections 323, 498-A, 506 IPC and under Sections 3 and 4 of Dowry Prohibition Act, against them.

2. It is alleged in the charge sheet that A1, at the instigation of A2 and A3, used to harass his wife i.e., de facto complainant, mentally and physically by demanding additional dowry, beat her mercilessly and abused her in filthy language. Based on the complaint, a case in Cr.No.432 of 2014 u/s.323, 498-A, 506 IPC and under Sections 3 and 4 of Dowry Prohibition Act, was registered against the accused.

3. Heard and perused the material on record.

4. In view of the serious allegations made in the complaint, this Court is not inclined to interfere with the impugned proceedings. At this stage, learned counsel for the petitioner confined his argument to the extent that the presence of the petitioners/A1 to A3 before the trial Court may be dispensed with. In view of the same, the presence of the petitioners 2 and 3/A2 and A3 except the first petitioner/A1 before the trial Court is dispensed with except on the dates whenever their presence is insisted by the trial Court and they shall be represented by their counsel.

5. With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
