M/S. Jaiprakash-Gayatri Joint Venture v. State Of Andhra Pradesh
THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE M.GANGA RAO Writ Appeal No.1527 of 2017 and Writ Petition No.28092 of 2017 COMMON JUDGMENT: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) After arguing for sometime, Sri L.Ravi Chander, learned Senior Counsel appearing for the appellants, would submit that, instead of adjudicating the matter on merits, it would suffice if the appellants-writ petitioners are permitted to withdraw the writ petition itself, and to avail the remedy of approaching the competent Civil Court. In the light of the submission of the learned Senior Counsel, we consider it appropriate to set aside the order under appeal, restore the writ petition to file, and dismiss the said writ petition as withdrawn with liberty to the appellants to avail the remedy of filing a Civil Suit before the competent Civil Court.
The writ appeal stands disposed of, accordingly. Miscellaneous petitions pending, if any, shall also stand dismissed. There shall be no order as to costs. _________________________________ (RAMESH RANGANATHAN, ACJ) ____________________ (M.GANGA RAO, J) 16th October, 2017 sur
