HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 41384 of 2018 ORDER:

1) Heard learned counsel for the petitioner and Sri N.Praveen Kumar, learned Standing Counsel for Municipalities, appearing for respondent No.2. 2) The present Writ Petition came to be filed seeking a direction to respondent No.2 not to cause any obstruction to the construction in the property admeasuring Ac.01.06 guntas, covered by Survey Nos.317 and 318 of Madaram village within the Parkal Municipality.

3) Though various grounds are raised, learned counsel for the petitioner would submit that pursuant to the notice dated 25.10.2018, a reply came to be filed on 31.10.2018. But, without passing any orders on the reply dated 31.10.2018, the authorities are trying to obstruct the construction in the property admeasuring Ac.01.06 guntas, covered by Survey Nos.317 and 318 of Madaram village within the Parkal Municipality.

4) Learned Standing Counsel, on instructions, would submit that any action to be taken by the authorities shall only be in accordance with law.

5) Having regard to the above, till appropriate orders are passed in the reply given by the petitioner on 31.10.2018 to the

notice dated 25.10.2018, the authorities shall not interfere with the property, except by following due process of law. 6) There shall be no order as to costs.
