HON'BLE SRI JUSTICE M. SEETHARAMA MURTI WRIT PETITION No.37575 of 2017 ORDER:

This writ petition is filed by the petitioner inter alia stating as follows: 'The petitioner applied for approval of plan on 04.11.2017 by paying necessary fee to the second respondent along with necessary documents for making constructions and that in a portion of the subject property, she constructed a small shed for storage of building material and that since 06.11.2017 afternoon, the officers and staff of the second respondent are visiting the site and asking her to remove the temporary shed and threatening to demolish the same, if she fails to remove the same.'

Learned counsel for the petitioner would submit that the photographs filed along with the writ petition reflect that there is a temporary shed and that the petitioner will take necessary steps in accordance with the procedure established by law in regard to the temporary construction in the subject property. Sri A. Panduranga Rao, learned Standing Counsel appearing for the second respondent, would submit that the second respondent would follow the procedure established by law before taking any coercive action.

Having regard to the submissions, the writ petition is disposed of directing the second respondent not to take any coercive action against the subject property of the petitioner except in accordance with the procedure established by law.
