HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.37657 of 2017 ORDER:

In this Writ Petition, the challenge is to the action of the respondents-authorities in not releasing the approved layout in favour of the petitioner for an extent of Acs.10.37 cents of land in Survey Nos. 43/2 to 9, 51/1, 51/7, 51/10, 51/11, 51/16, 51/18, 52/1, 52/3 to 5, 52/30A, 52/31A, 52/32 to 38, 53/2 to 15, 54/13 to 20, 67/17B, 67/18B, 67/19 to 29, 67/30A, 67/30B, 67/31 to 34, 69/19B, 69/20B, 69/22 and 69/23B of Thadi Village, Parawada Mandal, Visakhapatnam District. Learned counsel for the petitioner would submit that the case of the petitioner stands on the same footing as that of M/s Sai Priya Constructions Private Limited and that, insofar as the said other party, the layout has been released, but insofar as the petitioner, no action has been taken by the respondents despite its representation, dated 17.3.

2017, and the further fact that the petitioner paid the process fee and complied with all the formalities.

17.3.2017, of the petitioner in accordance with the procedure established by law and on the same terms as was done in the case of M/s Sai Priya Constructions Private Limited, the grievance of the petitioner would stand redressed. Learned Standing Counsel appearing for respondent Nos.2 and 3 would submit that the representation, dated 17.3.2017, of the petitioner would be considered and disposed of in accordance with the procedure established by law. Recording the afore-said submissions, the Writ Petition is disposed of directing respondent No.2 to consider and dispose of the representation, dated 17.3.

2017, of the petitioner within four weeks from the date of receipt of a copy of this order in strict accordance with the procedure established by law and by considering the case of the petitioner on par with the case of M/s Sai Priya Constructions Private Limited, if the petitioner is entitled to such consideration, and communicate the decision taken thereon to the petitioner within one week thereafter As a sequel, the Miscellaneous Petitions, if any, pending shall stand disposed of as infructuous.
