THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.6583 OF 2016

O R D E R

The prayer of the petitioner in this case is as under: 'To issue a writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents in not acting upon the Memo C.No.156/B6/2005-06 dt.20-03-2013 issued by the 3rd respondent as illegal, arbitrary and also violative of Art 300A of the Constitution of India and consequently direct the respondents to act upon the Memo and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.' The Memo dated 20.03.2013 issued by the Superintendent of Police, Ongole, required the Sub-divisional Police Officer, Darsi, to instruct the Sub-Inspector of Police, S.Magulur to vacate the premises housing S.Magulur Police Station and shift the police station to an alternate accommodation.

The grievance of the petitioner is that no steps were taken for vacating the said premises.

The Superintendent of Police, Prakasam District, Ongole, filed a counter-affidavit, wherein he stated that all efforts were being made to shift the police station to other premises without waiting for construction of the building. He concluded by stating that steps would be taken for vacating the premises within six months.

This counter-affidavit was filed on 29.03.2016. In the light of the aforestated undertaking given by the Superintendent of Police, Prakasam District, time is extended till the end of September, 2016 to act upon the Memo dated 20.03.2013 and vacate the subject premises, in which S.Magulur Police Station is presently housed. The writ petition is disposed of accordingly. Pending miscellaneous petitions shall stand closed. No order as to costs.
