HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 40954 of 2018 ORDER:
The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in interfering with the construction activity taken by the petitioners in Municipal House bearing No.2-48/ 13 VLT on Plot NO.13, admeasuring 150 sq.yards, having built up area of 100 sq.ft. in Survey Nos. 66, 67 and 68/ part, situated at Gachibowli, Serilingampally Mandal, Ranga Reddy district, under GHMC, Serilingampally Circle and thereby partly demolishing the compound wall raised by the petitioners, without issuing any notice, despite grant of Building Permission, vide Permit No.3/ C20/ 14442/ 2018, dated 05.09.2018, as illegal, arbitrary and improper, and consequently direct the respondents not to interfere with the construction work of the petitioners at the subject property.

Though various grounds are raised, the learned counsel for the petitioners submit that though the petitioners have obtained building permission, they have not raised any structures on the subject land, except a compound wall. He pleads that the action of the authorities in interfering with the construction of the compound wall without following due process of law, is improper. 3.
Sri Sampath Prabhakar Reddy, the learned Standing Counsel for Greater Hyderabad Municipal Corporation submits that any
action taken by the authorities would only be in accordance with law.

Having regard to the facts and circumstances of the case, the writ petition is disposed of, directing the authorities not to interfere with the property in dispute, except in accordance with law. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
