THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.17146 OF 2016 ORDER:
Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies.
The case of the petitioner, as seen from the contents of the affidavit of the petitioner, is that he was appointed as fair price shop dealer in respect of F.P. Shop No.13 of Patha Sangatipalli Village, Pendlimarri Mandal, YSR District, about four years ago. While so, on 12.02.2016 the 3rd respondent inspected the shop of the petitioner and found excess stock and a report was sent to the 2nd respondent to that extent. Basing on the same, the 2nd respondent issued orders in Ref.No.C/151/2016 dated 14.04.2016 suspending the authorization of the petitioner and the same was served on the petitioner on 28.04.2016. Again on 13.05.2016, the 2nd petitioner issued a show cause notice to the petitioner for which the petitioner submitted his explanation.
Alleging that the 2nd respondent had suspended the authorization of the petitioner without considering his explanation, the present writ petition is filed. As the allegations leveled against the petitioner are serious in nature, the respondent-authorities are bound to conduct an enquiry against the petitioner by taking into consideration the explanation submitted by the petitioner.
In the light of the aforesaid discussion and inasmuch as the petitioner has already submitted his explanation denying the allegations made against him, the respondents-authorities are directed to complete the enquiry and pass appropriate final orders within a period of six weeks from the date of receipt of a copy of this
order duly affording an opportunity of hearing. If enquiry is not completed by the respondents within six weeks, the suspension orders passed by the 2nd respondent stands suspended till passing of orders after completion of enquiry by the 2nd respondent. Accordingly, the writ petition is disposed of. No order as to costs.
In view of disposal of the main writ petition, miscellaneous petitions pending in the writ petition, if any, shall stand closed. _______________________ Challa Kodanda Ram, J 3rd June, 2016.
