THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI Writ Petition No.39352 of 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief/ s:

".... to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd respondent in not passing orders on the representations dt.29.09.2017 and 20.10.2017 submitted by the petitioner society to continue the petitioner society for supply of Auto drivers in pursuance of Tenders vide E.T.No.07/ 2017-18 for Item No.2 till new tenders are invited by the 2nd respondent and pay wages to its workers through petitioner contractor society as per circular ROC.No.1994/ 2007/ M1, dt.18.06.2008 as illegal, arbitrary and violation of Article 14, 21 of Constitution of India, and violation of provisions of Contract Labour Act, Payment of Wages Act and Labour & Industrial law and be pleased to pass such other order or orders......" (Reproduced verbatim) 2.

I have heard the submissions of the learned counsel for the petitioner and of the learned standing counsel representing the 2nd respondent.

At the hearing, learned counsel for the petitioner would submit that if the 2nd respondent is directed to consider and dispose of the representations, dated 29.09.2017 and 20.10.2017, submitted by the petitioner society, the ends of justice would be met. 4.

Learned standing counsel appearing for the 2nd respondent Corporation endorses the said submission.

Recording the afore-said submissions, the Writ Petition is disposed of directing the 2nd respondent to consider and dispose of the representations, dated 29.09.2017 and 20.10.2017, of the

petitioner society and pass appropriate orders in strict accordance with the procedure established by law within two (02) weeks from the date of receipt of a copy of this order, and communicate the decision taken thereon to the petitioner society within a week thereafter There shall be no order as to costs.
