THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.38048 of 2017 ORDER:

The grievance of the petitioners is in regard to the inaction of the 2nd respondent in initiating action on the representation, dated 28.10.2017, submitted by the petitioners for removal of illegal and unauthorized construction made by the 3rd respondent to an extent of 5 metres on the public road of a width of 10 metres. 2.

I have heard the submissions of Sri B.S.Reddy, learned counsel appearing for the petitioners, learned Government Pleader for Municipal Administration appearing for respondent No.1 and of Sri Md.Saleem, learned Standing Counsel appearing for respondent No.2.

Learned counsel for the petitioners would submit that if the representation of the petitioners is considered and appropriate action is taken, the grievance of the petitioners would be redressed.

Learned Standing Counsel for the 2nd respondent would submit that the representation of the petitioners would be considered and disposed of in accordance with the procedure established by law.

Recording the submissions, the Writ Petition is disposed of directing the 2nd respondent to consider and dispose of the representation, dated 28.10.2017, of the petitioners, strictly in accordance with the procedure established by law, within a period of two (02) weeks from the date of receipt of a copy of this order

and communicate the decision taken thereon to the petitioners within a week thereafter. However, the 2nd respondent shall initiate necessary action, if necessary, in accordance with law, against the illegal constructions said to have been made by the 3rd respondent.
