SMT JUSTICE T. RAJANI CRIMINAL PETITION No.12075 of 2018 ORDER:

This Criminal Petition is filed undpr Section 438 of Cr.P.C., to i grant anticipatory bail to the petitioners/A1 and 44 in Crime No.284 of 2018 of Alipiri Police Station, Tirupati, registered for the offences punishable under Sections 420 and 506 read with Section 34 lPC. 2.

Heard learned counsel for petitioners and the learned Public Prosecutor appearing for the respondent.

Learned counsel for the petitioners submits that the allegation l :

against the accused is with regard to the land, and in respect of the said land, the de-facto complainant filed a suit for declaration and the same was dismissed.

Hence, considering the above, this Court opines that this is a fit case to grant anticipatory bail to the petitioners/Al and 44. 5.

Accordingly, the Criminal Petition is allowed and the petitioners/Al and ,A4 are directed to surrender before the Station :

House Officer, Alipiri Police Station, Tirupati, within 15 days from the date of this order. On such surrender, the petitioners shall be released on bail on their executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) each with two sureties for a like sum each to the satisfaction of the said Station House Officer. Further, on such release, the petitioners shall abide by the conditions mentioned under Section 438(2) Cr.P.C., as under:

1) The petitioners shall make themselves available for interrogation by a police officer as afid when required;

2) The petitioners shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Courl or to any police officer; and

3) The petitioners shall not teave tnOia . without the previous permission of the Court.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
