HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.41093 OF 2018 O R D E R :

This writ petition is filed challenging the order dated 12.10.2018 passed by the 2nd respondent in case No.F3/2728/2018, wherein and whereby the 2nd respondent dismissed the stay application filed by the petitioner in the revision seeking stay of the order No.B/682/2017, dated 10.08.2017 of the 4th respondent and also order in Appeal No.D/1852/2017, dated 28.08.2018 of the 3rd respondent. Learned counsel for the petitioner submits that the petitioner was assigned an extent of Ac.2.00 guntas in S.No.266 of Husnabad Village and Mandal, Siddipet District, in the year 1962 and after assignment the petitioner is cultivating the same. He also submits that after long period, now, notice is issued alleging that the petitioner has not brought the subject land into cultivation within three years from the date of assignment and also sold out some part of the said land.

Heard learned Assistant Government Pleader for Revenue.

Since it is stated that statutory revision filed by the petitioner is pending before the 2nd respondent, if stay is not granted pending statutory revision, the petitioner will be

dispossessed. In view of the same, the 2nd respondent is directed to dispose of the revision filed by the petitioner, in accordance with law, after issuing notice to the parties. Till disposal of the revision, status quo obtaining as on today shall be maintained regarding possession of the subject land. Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 15.11.2018 t k.
