HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.4 0 9 4 2 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Inspector of Police, I-Town Police Station, Nalgonda, Nalgonda District, dated 14.1.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "On a complaint of the petitioner Md.Ibrahim, Asst. Sub-Inspector of Police, Maddirala Police Station, a case in Cr.No.268/ 2018 under Section 307 r/ w 34 I.P.C., dated 16.10.2018 was registered on the file of I-Town Police Station, Nalgonda, against 1) Sk.Nayeem, 2)Sk.Khareem and 3) Sk.Makhdoombhee, who are the son-in-law and his parents of the petitioner herein and taken up the investigation into the case.

During the course of investigation, the Investigating Officer examined as many as five (5) witnesses including the petitioner/ complainant and recorded their detailed statements.

Relevant CCTV footages were also collected as part of investigation into the case which was done at the time of scene of offence. The same is under scrutiny. It is submitted that there is no necessity for the respondents 2 and 3 i.e., the Superintendent of Police as well as the Deputy Superintendent of Police, Nalgonda District, to demand the petitioner to withdraw the above complaint registered against his son-in-law and his parents.

It is humbly submitted that the F.I.R. was registered on 16.10.2018. The investigation is at the initial stage. Some more evidence has to be collected to prove the offences mentioned in the FIR against the accused.

I humbly submit that I assure to his Hon'ble Court that the investigation will be completed within a period of

one month and an appropriate report will be filed before the concerned Hon'ble Court by following the due procedure.

I humbly submit that except conducting the investigation as contemplated under law, this respondent police never harassed the petitioner nor demanded him to withdraw his case registered against his son-in-law and his parents. To bring pressure on the investigating agency to immediate take action on his complaint and to divert the attention of the Investigating Officer in not conducting the investigation in a fair and proper manner, the petitioner filed the present Writ Petition with false and untenable allegations."

Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Sub-Inspector of Police, I-Town Police Station, Nalgonda, Nalgonda District, dated 14.11.2018, with a further direction to the respondent-police authorities to act strictly in accordance with law.
