THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3521 OF 2016 ORDER:

This petition is filed by the petitioner-accused No.2 under Section 482 Cr.P.C. seeking to quash the proceedings against her in Crime No.53 of 2016 on the file of Central Crime Station, Detective Department, ADR Team, Hyderabad, registered for the offences punishable under Sections 420, 406, 468, 471, 506 and 120-B r/w.34 IPC.

It is alleged that the petitioner along with her husband (A1) made the de facto complainant to believe and invest huge amount in constructing and running of hospitals by showing false and fabricated documents and also collected gold ornaments and pledged them and cheated the innocent people under the guise of arranging MBBS seats.

Learned counsel for the petitioner submitted that the petitioner is no way concerned with the above said allegations and she never interacted with the de facto complainant and that there are no specific allegations against the petitioner.

A reading of the entire complaint discloses that except stating that the petitioner was also present along with A1, who is her husband, there are no serious allegations against her and that there are some disputes between A1 and the de facto complainant since they are partners in running the hospitals.

Considering the above facts and circumstances and also considering that the petitioner is a lady, this Court is inclined to pass the following order:

The police concerned are directed to complete the investigation and file a final report, if any, without arresting the petitioner-A2. In the event of necessity, the police concerned are directed to issue notice to the petitioner for her appearance before the investigating agency for the purpose of investigation. On issuance of such notice, the petitioner shall appear before the investigating agency and give an undertaking as to her future appearance as and when required by the investigating agency for the purpose of investigation.

With the above directions, the Criminal Petition is disposed of.

Consequently, miscellaneous petitions pending, if any, shall stand closed.
