THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No. 2995 OF 2018 O R D E R:

This contempt case is filed alleging non-implementation of the order, dated 14.09.2018, passed by this Court in W.P.No.33142 of 2018.

By the aforesaid order, this Court directed the respondents to consider the representation, dated 20.08.2018, submitted by the petitioner for grant of 'No Objection Certificate' for construction of compound wall in the subject plots, within a period of ten days from the date of receipt of the said order. In the affidavit filed in support of the contempt case, the petitioner states that he submitted another representation, dated 24.09.2018, enclosing a copy of the order passed in the writ petition.

In the counter-affidavit, the respondents stated that the Field Staff submitted their report on 25.10.2018 and on consideration of the same, an order, dated 12.11.2018, came to be passed rejecting the representation of the petitioner. Learned counsel for the petitioner submits that the petitioner filed a writ petition assailing the order, dated 12.11.2018, alleging that there is a hostile discrimination being shown to the petitioner by not taking into consideration the similar permissions granted to others.

In the light of the above, since the petitioner filed a writ petition questioning the order, dated 12.11.2018, and considering the fact that the order, 14.09.2018, substantially, stands complied with, albeit with delay, the contempt case is closed. However, the respondents are warned to adhere to the orders of this Court with respect to the timeframe and failure of the same would invite initiation of proceedings against them under the Contempt of Courts Act.

Consequently, miscellaneous applications, if any shall stand closed.
