HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.35096 OF 2017 O R D E R :

The case of the petitioner is that he rendered services in the 3rd respondent temple since 1975 as an NMR and his services were regularized with effect from 01.06.1984 with the pay scale of Rs.290-5-345 to 425 with D.A at 42.5% and HRA at 4%. The petitioner retired from service on 01.06.2015. At the time of retirement the petitioner was having 120 days of Earned Leave to his credit. The grievance of the petitioner is that he is entitled for encashment of leave salary in respect of Earned Leave standing to his credit; and that in case of similarly situated person the 3rd respondent has paid the amount towards leave encashment, but he was not being paid the said amount.

The petitioner has also made representation to the respondents to consider his entitlement for encashment of leave salary in respect of Earned Leave and also to provide him temporary employment in the 3rd respondent temple as he has no other source of livelihood. In pursuance of the same the Assistant Commissioner of Endowments Department, Hyderabad recommended the petitioner's case through its letter in R.C.No.41/2014, dated 10.09.2015 to the 2nd respondent to permit him to pay an amount of Rs.1,20,266/- to the petitioner towards 103 days of encashment of Earned Leave salary.

Heard learned counsel for the petitioner and Sri A.Srikanth Reddy, learned Standing Counsel for 3rd respondent temple.

It is to be seen that when amounts are sanctioned to the petitioner by the Assistant Commissioner through proceedings vide R.C.No.41/2014, dated 10.09.2015 asking the 2nd respondent to permit him to pay an amount of Rs.1,20,266/-, to the petitioner towards encashment of Earned Leave, it is not known why the said amount is not paid to the petitioner, till date.

In view of the same, the 2nd respondent is directed to consider the representation of the petitioner dated 07.08.2015 and take action accordingly, within a period of eight (8) weeks from the date of receipt of a copy of this order. Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 25.10.2017 t k.
